Terms and Conditions

Contract for the Supply of Products or Services

1. No contract for the supply of products or goods will be deemed to exist between you and French Frolic unless, and until, an email is sent by us to you confirming that your order has been accepted and payment has been successfully made.

2. This confirmation e-mail amounts to an acceptance by us of your offer to buy goods or services from www.frenchfrolic.com (or www.frenchfrolic.co.uk) and this acceptance is effective regardless of whether or not you receive the e-mail.

3. We are free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods or services, any description applied to the goods or services, the availability of the goods or services, or the order itself.

4. The contract is subject to your right of cancellation if you are a consumer

Availability and Description of Goods

5. All goods advertised for sale on our site are subject to availability. If an item is unavailable we will inform you by e-mail or by telephone.

6. We will not charge you for goods that we cannot supply. However we will not be responsible for any damage or losses that you may suffer if we fail to supply goods.

7. We display the goods on the site as accurately and fairly as possible but are subject to the available reproduction techniques.

8. All vintage or antique goods on the site are in used condition unless otherwise stated. Any defects or damage, other than general ageing, will be specified in the description.

Prices of goods

9. The prices displayed on our site are correct at the time of display. We reserve the right to alter prices from time to time without notice.

10. When we have accepted an order we will not change the price that applies to that order.

11. The prices displayed are inclusive of VAT if and where applicable.

12. In addition to the price, you will be required to pay a delivery charge for the goods. This delivery charge will be displayed either on the Delivery Information Page or on your pre-order statement at Checkout, shown prior to your confirmation of the order and your payment for the order.

Payment Information

13. We use the services of Paypal for processing your payment.

14. We accept payment by Visa/MasterCard or any other credit or debit card identified as acceptable by Paypal.

15. Credit and charge card payments are subject to validation and authorisation by the card issuer and we will not be liable for any non-delivery or delay if a card issuer refuses to authorise payment.

16. Payment by cheque may be possible if agreed and authorised in writing (email) by French Frolic to you before your order is placed.

Dispatch of Goods

17. We will dispatch the goods to the address you give us at the time you place your order.

18. We will dispatch the goods within 1 business day of receiving cleared payment. Business days do not include weekends or public holidays.

19. We will inform you of the date on which your goods have been or will be dispatched, and of the expected delivery time as quoted by the postal or courier delivery service used.

20. Once goods have been dispatched by us, we are not responsible for the delivery time of the postal or courier service used for the delivery of the goods, and will not be liable for any loss or damage suffered by you through any delay on the part of the postal or courier delivery service.

Right of Cancellation

21. You have the right to cancel the contract at any time up to 7 business days after you receive the goods. A business day is any day other than weekends and public holidays in the United Kingdom or France.

22. To exercise your right of cancellation, you must give written notice to French Frolic by email, to the email address shown on this site, giving details of the goods ordered (and of their delivery where applicable) and your request to cancel.

23. If you exercise your right of cancellation after the goods have been delivered to you, you must return the goods to French Frolic at your own cost, in unused and otherwise re-saleable condition. The goods must be returned to the address shown in the Contact Us section of this site within 28 days. You must take reasonable care to ensure the goods are not damaged whilst in your possession or in transit.

24. If you notify us that you are cancelling the contract before dispatch of the goods, we will refund or re-credit you within 7 days for any sum that has been paid by you or debited from your credit/debit card for the goods.

25. If you notify us that you are cancelling the contract after the goods have been dispatched, we will refund or re-credit you within 7 days for any sum that has been paid by you or debited from your credit/debit card for the goods once the goods have been received by us and determined to be in the same condition that they were dispatched.

Returns

26. If you consider your goods to be significantly not as described and/or photographed, you should email us within 7 days of delivery with photographs of the goods, highlighting the discrepancy. If the goods are shown to have been mis-described or photographed, we will refund the cost of the purchase, including postage costs, in full. We may or may not require the goods to be returned to us. If we do require the goods to be returned to us we will pay for the return postage.

27. We want you to be happy with your purchase - if you are not entirely satisfied and want to return the goods, even though the goods are as described/photographed, you should notify us by email of your request to cancel the transaction within 7 days of the delivery of the goods, and the goods must be returned to us (in their original packaging) at your own cost. When the goods are received by us, in the condition they left us, we will refund your purchase payment excluding postage costs within 7 days.

28. In the event of the goods being damaged in transit, we will require photographs of the damaged goods to be emailed to us. Where appropriate, we will replace the damaged item or part thereof. When this is not possible, we will work with you to determine a solution which could include, but is not restricted to, the cost of repair / a partial refund /a full refund. If we request that the goods be returned to us, we will pay the return postage.

29. This does not affect your statutory rights as a consumer.

Privacy Policy

30. We are committed to protecting your privacy. We will only use the information that we collect about you lawfully in accordance with the Data Protection Act 1998, to process your order and to provide you with the best possible service. We do not disclose buyers information to third parties. We do not store or have access to your credit/debit card details. We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. The personal information which we hold will be held securely in accordance with our internal security policy and the law. Cookies are used on this site, but only to keep track of patterns of behaviour and to maintain the contents of your shopping cart.
